Return, Cancellation, and Refund Policy

No Refunds Policy: Upon your engagement with POOL of Cars, we immediately initiate marketing and selling efforts for your vehicle. Due to these upfront investments, all service fees paid are non-refundable. These fees encompass advertising, initial setup, administrative tasks, and initial marketing activities.

Service Commitment: We are committed to providing a full range of services as outlined in our offering. This commitment underscores our dedication to maximizing your vehicle's market potential.

Changes to Services: We may modify, adjust, or discontinue any services at our discretion to effectively adapt to market changes or technological updates, ensuring the best possible service quality.

Cancellation by Client: You can cancel the service agreement at any time. If cancellation occurs after the commencement of services, a $49 cancellation fee will apply to partially cover costs already incurred.

Conditional Refund Policy: Our fees are generally non-refundable. However, we may consider refund requests on a case-by-case basis, especially if our services did not meet the agreed standards due to our performance. Refund requests must be submitted in writing via email and, if approved, will be processed minus any credit card fees, advertising costs, and other incurred expenses. Refunds may take up to 30 days to process.

The terms supporting our guarantee include:

  • Responsiveness: You must respond to potential buyer inquiries within two hours during business hours.

  • Complete and Accurate Information: All vehicle details must be comprehensive and precise.

  • Vehicle Availability: The car must be readily available for viewings and inspections.

  • Dynamic Pricing Strategy: We'll set the initial listing price through mutual agreement based on detailed market research. To keep the pricing competitive, we may adjust it every three days according to market trends.

  • Market Conditions: The guarantee's applicability is contingent on prevailing market conditions and may be adjusted accordingly.

  • Remedy if Guarantee Is Not Met: If a qualified buyer is not secured within the agreed period due to factors within our control, we will offer additional marketing efforts at no extra cost or adjust our service fee.

Customer Cooperation: Effective marketing and sale of your vehicle require your active participation. This includes timely communication, prompt provision of necessary documentation, and availability for required actions. Responding to our communications and those of potential buyers within 2 hours during business hours is crucial, as delays can result in lost sales opportunities.

Governing Law and Dispute Resolution: This policy is governed by the laws of our registered jurisdiction. Any disputes not resolved through direct contact may be subject to binding arbitration.

Amendments to This Policy: We reserve the right to amend this policy at any time. Updates will be effective immediately upon posting on our website.

Dispute Resolution: In the event of a disagreement or dispute relating to the services provided, it is strongly encouraged to contact us directly for a resolution. We strive to resolve any disputes amicably and quickly.

Informal Negotiations: To expedite resolution and reduce the costs of any dispute, controversy, or claim related to this Return and Refund Policy ("Dispute"), you and POOL of Cars agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating any arbitration or court proceeding. Such informal negotiations commence upon written notice from one party to the other.

Binding Arbitration: If you and POOL of Cars are unable to resolve a Dispute through informal negotiations, either you or POOL of Cars may elect to have the Dispute (with the exception of those Disputes expressly excluded below) finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party shall be final and binding on the other. The arbitration shall be conducted in the state in which our company is registered.

Restrictions: You and POOL of Cars agree that any arbitration shall be limited to the Dispute between POOL of Cars and you individually. To the full extent permitted by law, (1) no arbitration shall be joined with any other proceeding; (2) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (3) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions to Informal Negotiations and Arbitration: You and POOL of Cars agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of your or POOL of Cars' intellectual property rights; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.

Updating Your Information: If any of the information you have provided to POOL of Cars changes, such as your contact information, address, or a vehicle’s legal status, please keep us informed as soon as possible. This is important to ensure that all communications and services proceed smoothly and according to plan.
